After reading my husband your posts, the one where you suggest had it been in your power, you would have hit me in the side of the head with a baton, and then the one where you suggest that a fitting end to our ordeal would have been for me to be tazed, and then this little tidbit below, my husband said he would be delighted to share his thoughts with you IN PERSON. Venetian, please enlighten me--How is one "not like" the other? Because I didn't rewrite WORD FOR WORD what I had written before? Ummm…that's because I didn't memorize a script, IT ACTUALLY HAPPENED.I just re-read both accounts, and I fail to see how one is substantively different from the other.
Is it because I added/subtracted different details? There are more details I could tell you too--But somehow it doesn't seem pertinent to mention Sgt. Evan's hairstyle that night, or the fact that she was wearing shorts, or any other myriad of little details. I am attempting to be SUCCINCT in the hopes that the WHOOOOle post actually is read.
I realize it is just a very few vocal posters (One can hope they are simply angry adolescents posing as adults--seems quite likely given the tenor and spelling mistakes/grammatical errors/misuse of language in some of the posters' responses) who make things hateful, not helpful, but sadly they are like zombies--too much contact, and you begin to turn into one of them.
I think the great use of this type of forum is that good people of good conscience have a way to come together to effect social change--I am still optimistic enough (despite the personally abusive, rude and/or threatening comments I have engendered by posting on here) to think that by writing about what happened to me that night, that it may do some good. Certainly I am not stopping here--I have been advised to bring it before the City Council, which I may very well do, as well as the complaints I have already filed with LAPD and the Police Commission.
*Bret, Peggy Thusing is aware of this situation, as well as Paola Kreeft. I would LOVE to hear what either of them has to say on this issue, but I'll just bet you they both decline--It's in their Internal Affairs division already.
Loulou, I am waiting for the movie.

As for your inability to get your day in court, that's an issue you should be able to deal with. All you need to do is to file suit against the city for denial of due process. You have an absolute constitutional right to your day in court in a timely manner. If the officer cited you but fails to file your citation in a timely manner, then he is denying you your due process. Speak to your attorney and find out what steps you need to take. My suspicion, not being a lawyer, is that you would need to document when you received your citation and then a reasonable effort to get your case heard.
As for being handcuffed, chances are you are out of luck on that one. The police have a certain right to detain someone without using unreasonable force. Handcuffing you, albeit uncomfortable, would be hard to prove as being unreasonable force. You apparently were seen by a paramedic but didn't require any treatment. Handcuffs can leave some bruising on the wrists if you struggle while in them. Not sure that the courts will outlaw the use of handcuffs because you bruised your wrist though.
As for what the police officer said to paramedics about your perceived history of violence, that's probably something that you are equally out of luck on. You are on video tape being highly confrontational to police, so you do have a history justified or otherwise. You aren't exactly Venice's Rodney King, so there's no real police brutality here. Of course you felt a bit humiliated at being handcuffed, but they were within their rights to detain you at the time.
Unfortunately for you, much of what you speak of on here is still hearsay according to the law. You don't really have any evidence to back up what you are saying. You have your husband as a witness, who by your own admission was too far away to see or hear what was happening. You also may wish to re-evaluate your marital status. If it were my wife being treated as you describe, I'm afraid I would be in handcuffs with her, as I would have politely refused to leave her side. But then, I love my wife for putting up with me all these years, so a few minutes in the back of a squad car seems to be the least I would do for her.
You have a citation, so you have a case to use to force the city to strike the ordinance instituting the curfew on OFW. Pursue it vigorously, and let us know how it all turns out.

Wow – look who's 'advocating violence' now. Actually it sounds like a genuine physical threat. I'm sure this isn't the first time your mouth has gotten your husband into trouble. Have him PM me – I have some support groups I can suggest for him…
(PS – I know she's actually correct on ruckus vs raucous but I couldn't let her get the last word)

What's the problem, Con? I PMd you asking for a place and time to meet so I can share my thoughts with you as you requested, but you haven't responded.
Since you seem to be so concerned for me, I would like to show you my appreciation face to face.

I spoke with Senior Lead Officer Peggy Thusing earlier today.
In regard to "Loulou"'s run in with the LAPD on Ocean Front Walk, as it appears that Loulou has taken this to internal affairs they can't really say much besides that it is "under investigation".
Also, the Officer Eduardo Bermudez that is listed on page two of this thread was not part of the dispute on Ocean Front Walk with "Loulou". Officer José Bermudez was the officer that was involved.
Officer Eduardo Bermudez was found not guilty of all accusations by an internal affairs board at the LAPD.
